BY-LAW 1                                    ( SECTIONS 1 – 8 CONSTITUTIONS)

 

1.           Section One Constitution.  

 

              a.   Officers and Committee.                     The Officers of Section One shall be:

 

              Section Secretary who shall be the Area Delivery Representative for the LS Postcode Area.

 

              Section Chairman / Organiser who shall be the Area Delivery Representative substitute for the LS               Postcode Area and who will work in liaison with the Branch Organiser as a member of the Branch Organising Committee and will attend the Organising Secretary’s monthly meetings.

 

              They shall serve on a Section Committee together with representatives and substitute representatives from each Delivery Office within the LS Postcode Area.

 

              To enable CWU Leeds No 1 Amalgamated Branch representatives to carry out their role in the best interests of the members that they are responsible to, it is mandatory for representatives to attend all appropriate training courses that will give them necessary information/skills to do so.  

  • Elections.

 

Section Officers shall be elected by an individual members ballot of the total section membership as per Branch Rule 9.3.  Workplace Representatives shall be elected by the membership in each workplace delivery unit. 

  • Vacancies.

 

Vacancies in any official position on the committee which arise between Annual General Meetings shall be filled as per Branch Rule 9.5.

 

  • Section Meetings.

 

The section will hold not less than 6 bi-monthly committee meetings per year.  The Section Secretary shall have the authority to convene special committee meetings.

 

The Section shall hold not less than two general meetings each year, one of which shall be held in January.  Delegates nominated by the Section committee members will attend the two half yearly Business Co-ordination meetings relevant to their sections.  The Section Secretary and Central Secretary shall have the authority to convene special general meetings of a section when, in their judgement, such a meeting is necessary.  The Section Secretary shall also convene a special general meeting when such a meeting is called for by a requisition signed by not less than 28 fully paid up members of the section.  A requisition for a special general meeting shall state fully and clearly the specific purpose for which the meeting is desired.  No business shall be transacted at a special meeting except that which is announced on the notices convening the meeting.

 

Any such meeting called by requisition will only commence or conduct such business provided 75% of those persons signing such a requisition for a special meeting are in attendance.  Any such requisition shall have the members name printed on it and also carry the members signature.

 

The Central Secretary shall be informed of the date, time and venue of all; section general special meetings and committee meetings.  Not less than 14 days notice shall be given of any section general meeting and the terms of resolution and particulars of any motions shall be submitted three clear days before the meeting.  The Central Secretary and President are allowed to attend all Section General and committee meetings.   

 

  • Workplace meetings.

The relevant Section Secretary will be given 24 hours notice by the relevant workplace/unit representative of any workplace meeting called by the members or the workplace

 

representative.  If it is an emergency meeting the Section Secretary must be immediately informed.  If the Section Secretary is unavailable the Section Chairperson must be informed in the same timescale.  If the Section Chairperson is unavailable the Central Secretary must be informed in the same time scale.  The relevant Section Secretary or Chairperson will be invited by the relevant workplace / unit representatives to all workplace meetings called by the members or the workplace / unit representative.  The Section Secretary or Chairperson will inform the Central Secretary of all workplace meetings to be held.

 

2.           Section Two Constitution.

              Section Secretary who shall be the Branch Nominee as the Area Distribution Representative.

 

              Section Chairman / Organiser who shall be the Branch Nominee as the area Distribution Representative substitute and who will work in liaison with the Branch Organiser as a member of the Branch Organising Committee and will attend the Organising Secretary’s monthly meetings.

 

              They shall serve on a Section Committee together with the following representative:

              They shall serve on a Section Committee together with the following representatives:

              Section Chairman / Organiser who shall be the Branch nominee as the Area and Delivery  Substitute Representative for the WF/HG postcode Delivery Office and who will work in liaison with the Branch Organiser as a member of the Branch Organising Committee and will attend the Organising Secretary’s monthly meeting.

             

              They shall serve on a Section Committee together with the following representatives:

              Section Secretary, who shall be the Branch nominee for the Regional Counters Representative for the North East.

 

              Section Chairman / Organiser who shall be the Branch nominee as the Regional Counters Representative for the North East Substitute and who will work in liaison with the Branch Organiser as a member of the Branch organising Committee and will attend the Organising Secretary’s monthly meeting.

 

              They shall serve on a Section Committee together with the following representatives:

8.           Section Eight Constitution.     Branch Retired Members

 

              Section Secretary and Section Chairman will be elected in line with Branch Rule 9.

 

              They shall serve on a Section Committee of six other Branch Retired Members.

 

By-Law 2

 

  • Section Secretaries 1 – 8. 

    • To perform all Secretarial duties relative to the Section. 

    • In consultation with the Section Chairman / Organiser to convene all section committee and section general meetings and to inform the Central Secretary of the date, time and venue of the same. 

    • If required, the Section Secretary in consultation with the Central Secretary will have the authority to form Sub-sections within a section. 

    • To publish a report in the Branch Annual Report. 

    • To carry out instructions given by the section committee and section meetings and to keep the section membership informed of any decisions and agreements reached with management. 

    • To keep the Central Secretary informed of any changes of section committee members etc, submit any section agreements reached and forward copies of section committee and general meeting minutes as necessary. 

    • To attend all Central Committee Meetings and give a report on their Sectional matters.

 

  • Section Chairman / Organiser. 

    • To preside and be responsible for the conduct of all section general and committee meetings. 

    • To assist the Section Secretary and substitute for the Secretary as necessary. 

    • To attend all Central Committee meetings. 

    • To work in liaison with the Branch Organiser as a member of the Branch Organising Committee.

 

By-Law 3

 

              Conduct of Biennial Ballot. 

    • On the 2nd Monday in December the Central Secretary or other designated Branch            Officer, as determined by the Branch Committee, shall send a notice to each office and work area where Leeds No1. Amal Branch members are employed inviting nominations for the positions advertised. 

    • Any ballots that are needed will be conducted by the Returning Officer and Scrutineers appointed by the committee. 

    • The ballot paper will be despatched 15 days before the Annual General Meeting of the Branch. 

    • The Returning Officer shall circulate to all offices and work areas where Leeds No 1 Amal Branch members are employed a notice stating the date on which the Ballot Papers are to be despatched.  The notice shall also state that it will be the responsibility of the individual member who does not receive a Ballot Form within three (3) days of the despatch to inform the Returning Officer of the fact in order that a Ballot Form can be issued. 

    • The Ballot will close at 10.30am on the Friday before the Annual General Meeting. 

    • In the event that a “No quorum” situation arises at a meeting where ballot results are to be announced, then the ballot results will then be published and displayed on all notice boards where Leeds No 1 Amal Branch members are employed.  After publication, any questions with regard to the Ballot must be in the hands of the Returning Officer within 3 days.

 

 

By-Law 4

 

              LEEDS MAIL CENTRE ULR’S CONSTITUTION

 

There will be 6 ULR positions at the Leeds Mail Centre, one of which will be known as the Lead ULR.  The role and responsibilities of the ULR’s will be to: 

  • Work and liaise with the Branch Learning/Training Officer in making the learning opportunities agenda accessible to members. 

  • To work and liaise with the Branch Learning/Training Officer in being responsible for the sustainability and management of the Learning Centre within the Leeds Mail Centre. 

  • To make themselves available for all relevant training courses.

 

By-Law 5

 

                      Area/Regional Health and Safety Representatives

 

              Any members of the Branch who have been elected to a Business Based Area/Regional Health and Safety representative position will have the following responsibilities to the Branch:- 

  • He/she will attend and make a report to two Section meetings of all Sections relevant to the Business that he/she holds a representative position for.                               

  • He/she will attend and make a report to all relevant half yearly Business Based Co-ordinating meetings that he/she holds a representative position for. 

  • He/she will forward the Central Secretary, every month, a written report on the activities and representational matters that he/she has been involved in.

 

                                  (d)    To attend and give a report at all Central Committee meetings.

 

By-Law 6

 

                      Special Leave for Union Purposes.

 

              This By-Law only affects those whose Special Leave entitlement is not covered by the terms of the National Agreement on the facilities for Special Leave for Union purposes.

 

              Every effort should be made to keep Special Leave to a minimum and permission of the Central Secretary or in his absence, the Branch President or Branch Treasurer, should be obtained before Special Leave is taken.

 

By-Law 7

 

                      Central Committee.

 

              The Central Committee shall consist of the Branch officers and Section Secretaries and delegates from each section in line with Branch Rule 7. the Central Committee will elect annually delegates from the following committees:

 

  • Finance & General Purposes Committee

 

  • Political Sub – Committee.  (to be members of the Labour Party)

 

  • Education Sub – Committee

 

              All motions intended to be submitted to a Central Committee shall be in the hands of the Branch Central Secretary 4 days before the meeting.

 

By-Law 8

 

              Remuneration of Branch & Section Officers and Committee Members. 

  • The Following officers shall receive a payment within this By-Law, which shall be known as an Honorarium and shall be paid quarterly.

  • Branch Officers, Section secretaries and Royal Mail Area Health & Safety Representative shall be paid the cost of telephone rental whilst in office. 

  • Officers and Committee members shall be paid 2 pounds refreshment allowance payable at each central committee. 

  • Officers and / or members called upon to work on behalf of the Branch in non-working hours of attendance can claim section subsistence.  Authority should be by agreement of two of the following officers:

  • Officers and Section committee members attending section committee meetings shall be paid 2 pounds refreshment allowance, payable at each meeting. 

  • Officers and Section committee members attending section committee meetings or central committee meetings shall be paid local bus fares relevant train fares on production of a receipt/ticket or if using own private transport the applicable C.W.U. mileage rate payable at each meeting.  

  • Any Branch Officer, Section Secretary, Section Chairman/Organiser, Section Representative or Health and Safety Representative will be given a £20.00 (per full day) grant to meet out of pocket expenses when attending a National Education/Training School.  A subsistence payment as laid out in the National rules will be paid for any part day. 

  • When the number of Branch members attending a Branch General or a Branch Special General Meeting is below the number required to form a quorum, those members will be paid travel expenses.

 

By-Law 9

 

              Donations 

  • The Branch Central Committee shall have the authority to vote a sum of money not exceeding 100 pounds to any deserving cause.  All requests for donations intended to be submitted to a Central Committee meeting shall be in the hands of the Branch Central Secretary 4 days before the meeting. 

  • A Branch donation equivalent to 10% of the National Death Grant will be paid to dependants of any Class A, B and C member who dies whilst still in C.W.U. membership. 

  • A floral tribute will be sent in the case of any member who dies whilst still a member of the Union. 

  • A floral tribute will be sent in the case of an Honorary Member of the Branch dies. 

  • A cash donation in lieu of flowers may be sent to Charities named by dependants of the bereaved member.  The amount not to exceed the cost of the floral tribute.

             

 

By-Law 10

 

              Branch Auditors

 

              Two Auditors, not members of the Central Committee or a Section Committee, shall be elected at the Annual General Meeting and they shall audit the accounts as outlined in National Rules.

 

 

By-Law 11

 

              Affiliations.

 

          The Branch shall affiliate to:

 

  • The Leeds T.U.C.

 

  • Any other organisation decided by the Annual General Meeting or the Central Committee that upholds C.W.U.

           National Policy.

 

 

By-Law 12

 

              Branch Honorary Membership. 

  • Branch Honorary Membership could be conferred on all long-serving Branch Officers, posthumously to Branch Officers who dies in post as approved by the Central Committee. 

  • A copy of the C.W.U. Diary will, annually in December, be forwarded to retired Honorary Members.

  • Honorary Members will be paid travelling expenses when attend Branch Annual and Half – Year General Meetings. 

  • A floral tribute will be sent in the case of Honorary member who dies. 

  • A cash donation in lieu of a floral tribute may be sent to Charities named by dependants of a bereaved Honorary member.  The amount not to exceed the cost of a floral tribute.

 

By-Law 13

 

              Branch Delegates to Conference.

 

  • The delegates to Annual Conference shall be the Branch Officers (excluding Vice President) & Section Secretaries.  Also trainee delegates will be part of the delegation, dependant on Branch funds, elected by the Central Committee. 

  • The election of trainee delegates will be determined at Central Committee and Section Committee Meetings over the previous 12 months, with the aim that all trainee delegates will be attending their first Annual Conference. 

  • The composition of the Branch Officers, Section Secretaries and Trainee delegates will reflect that the Branch is adequately represented in all business and grades. 

  • Special Conference delegations shall be determined by the Central Committee, taking into account the number required, the cost and grade specialisation. 

  • All delegates and trainee delegates will be expected to sit together in the conference Hall areas designated for visitors when they are not required to occupy the Branch seats on the floor of Conference. 

  • If it is necessary for evening meetings to be called to discuss Conference business, all delegates and trainee delegates will be required to attend without exception. 

  • Delegates to Business based / Sectional conference, on completion of the Business Based / Sectional conferences, will report to the Branch President and Central Secretary or their substitutes when on the site of Conference. 

  • The delegation shall be under the direction and control of the Branch President and Central Secretary or their substitutes when on the site of Conference.
